A Quick Summary

In a legal battle from Tiruppur, the case of K. Palanisamy, who sadly passed away, continued with his family stepping in. The case was about a disputed property sale. The court, led by Judge R. Sakthivel, decided on February 24, 2026, to dismiss a request challenging an earlier decision to allow a late appeal.

The Original Suit

The story began with a lawsuit filed by K. Palanisamy in 2013 at the Tiruppur court. He wanted to cancel a sale agreement from September 17, 2012, claiming it was unfair. The goal was to stop the other side from interfering with the property and get back important documents.

The Ex-Parte Decree

Things took a turn when the second person being sued, Palaniammal, didn't show up in court because she was sick. A decision was made against her on August 20, 2018, without her being there. Later, she said she was getting traditional treatment for a viral fever, which kept her away.

"I was sick and couldn't attend the trial," she explained.

The Delayed Appeal

Palaniammal filed for an appeal, which was 470 days late, saying her illness was the reason. Her request was supported by a medical certificate from a regular doctor, which raised questions because she mentioned traditional treatment.

Court's Decision

The trial court decided to allow the appeal, as long as she paid Rs. 3,000 to Palanisamy. This decision was challenged by Palanisamy's side, arguing the medical certificate was misleading.

Justice R. Sakthivel's Ruling

Judge R. Sakthivel looked into the situation and found no problem with the trial court's decision. He emphasized that the focus should be on whether Palaniammal was truly sick, not the type of medical certificate she presented.

"The length of delay isn't as important as the reasons for it," he noted.

Verdict

On February 24, 2026, the court dismissed the revision petition, allowing the appeal to move forward. This decision was made to ensure fairness and justice in the case.
