Summary: The court has ordered that land documents, which were previously not allowed to be registered because of past legal fights and notices, must now be registered. Judge K. Sarath handled the case.
The case is about land in Sy.No.44 at Maktha Mahabubpet Village, Ranga Reddy District. The people who own the land, V V Subba Rao and Gumireddy Sreerami Reddy, had trouble getting their land documents registered because the authorities said no. This refusal was because of a notice from 2013.
In an earlier case (W.P.No.33090 of 2023), the court had already told the authorities to register similar documents without paying attention to the 2013 notice. The current case involves the same piece of land, and the refusal was based on a letter from the District Collector dated October 3, 2024.
"The respondent No.3 issued impugned Refusal Order No.276 of 2025, dated 19.07.2025."
The land has a complicated legal past. In 2014, a court decision canceled earlier administrative choices about the land. Despite this, the land was still marked as restricted, which went against court orders. Appeals were made, but the higher court dismissed them in November 2024.
Judge K. Sarath, after listening to both sides, instructed the Registering Authority to handle V V Subba Rao and Gumireddy Sreerami Reddy's documents without considering the refusal order or the letter from 2024. However, the registration must follow the rules of the Indian Registration Act and Indian Stamps Act.
"This writ petition is disposed of directing the Registering Authority to receive, register, and release the subject document."
The court's order does not stop the government or District Collector from taking legal actions to claim ownership. Any ongoing legal cases will affect whether the registration is valid.
"The registration of the document will be subject to the result of that proceedings/suit/appeal."
This decision is an important step in sorting out the ongoing disagreements over the land registration and making sure legal orders are followed.
