Telangana High Court: Professor's TDS Refund Delayed Due to Form Error

Ever had a tax refund stuck because of a silly mistake? That's what happened to Narayana Pant Pemmaraju, a professor who found himself in a pickle over a tax mix-up. But don't worry, it all got sorted out in the end!

The Refund Roadblock

Narayana Pant Pemmaraju was waiting on a tax refund. But there was a problem. The buyer, G Randhir Ram Reddy Tavva, accidentally deposited the Tax Deducted at Source (TDS) amount of ₹2,09,74,830/- in the wrong form. Instead of using Form 27Q, he used Form 26QB. This little slip caused a big delay.

"The software doesn't allow for corrections," said the Centralized Public Grievance Redress and Monitoring System when they declined the request to fix the error.

Taking it to Court

Frustrated, Narayana Pant took his problem to the court. The case was heard by Chief Justice Sri Aparesh Kumar Singh and Justice G.M. Mohiuddin. Both sides were represented by their legal teams, with Sri Duvva Pavan Kumar speaking for Narayana Pant and Sri Vijhay K Punna for the Income Tax Department.

Resolution at Last

On August 11, 2025, the court asked the Income Tax Department to provide a written statement. The department confirmed that they had given Narayana Pant the TDS credit and issued the refund. Finally, Narayana Pant's issue was resolved.

"The issue of the petitioner has been fixed," said Narayana Pant’s lawyer.

Case Closed

With the refund sorted and no further costs involved, the court closed the case. All's well that ends well!

This case is a reminder that even small errors can cause big headaches, but with persistence, they can be resolved.
