Telangana High Court: Petition Dismissed as Police Inaction Cannot Be Challenged Under Article 226

Ever wondered what happens when you file a complaint with the police, but they don't register it as a case? Well, that's exactly what happened to Gondeti Laxman, a 60-year-old beedi company agent from Telangana. He took his issue to court, but things didn't go as planned. Let's break it down.

The Petitioner's Complaint

Gondeti Laxman filed a request because the police didn't act on his complaint from June 7, 2016. He wanted the court to make the police take action against Ippakayala Narasingam, another resident from his village. Laxman also asked for police protection.

The Court's Take on the Matter

Judge N. Tukaramji handled the case. He listened to arguments from various government representatives, including Mr. R. Laxmikanth Reddy and Ms. Roohi Nabeela. They argued that Laxman's request for the police to register a case wasn't valid under the law.

"The relief sought...is not maintainable under Article 226 of the Constitution of India," said the Assistant Government Pleader.

Previous Court Decisions

The court referred to earlier decisions made by the Supreme Court. In cases like Sakiri Vasu v. State of U.P., it was made clear that if the police don't register a First Information Report (FIR), filing a request like Laxman's isn't usually the right move. Instead, there are other ways to address this issue.

Why the Petition Was Dismissed

The court found no special reasons to step in and dismissed Laxman's request. Judge Tukaramji pointed out that Laxman could still use the solutions provided by the law.

"The statutory scheme provides sufficient and efficacious remedies before the competent Magistrate," the court noted.

What's Next for Laxman?

Although the request was dismissed, Laxman can still take his complaint to a Magistrate. The court's decision didn't leave him without options; it just redirected him to the right path.
