Summary: The court has ordered the National Faceless Appeal Centre to resolve a four-year-old tax appeal within four months.

Background of the Case

Matrix Green Power Private Limited, represented by its Director, Sri Kasu Abhiram Reddy, filed a request with the court. The main request was to get a decision on an appeal they filed back in May 2021. This appeal was against a tax decision made in April 2021 by a faceless tax authority.

The Long Wait

Matrix Green Power Private Limited, through their lawyer Ms. K. Mamata Choudary, pointed out that the appeal had been waiting for over four years. According to the rules, appeals should be decided within a year. This long wait forced the company to seek help from the court.

What the Respondents Said

Ms. B. Sapna Reddy, representing the Income Tax Department, agreed that the appeal should be addressed quickly. She suggested that the court should instruct the Appellate Authority to deal with the appeal within a reasonable timeframe.

Court’s Decision

The court, led by Chief Justice Sri Apresh Kumar Singh and Justice G.M. Mohiuddin, recognized the problem. They ordered the National Faceless Appeal Centre to resolve the appeal within four months of receiving the court's order. The judges made it clear they did not comment on the details of the case itself.

"The Appellate Authority/National Faceless Appeal Centre shall dispose of the said appeal within a period of four months..."

Verdict

The court closed the request without any order on costs. Any other pending applications related to this case were also closed.
