The case involved claims against her husband, Nikhil Rajendra More, and his family.

Background of the Case

Vishakha Nikhil More married Nikhil Rajendra More on November 29, 2022, and lived with him in Latur. In March 2023, she made a complaint against him and his family for mistreating her. Later, she filed a domestic violence case in Chhatrapati Sambhajinagar, saying she was living there for school purposes.

Location Dispute

Nikhil Rajendra More and his family argued that Vishakha did not live in Chhatrapati Sambhajinagar and was actually living with her parents in Borda, Kalamb. They claimed that the case was filed in Chhatrapati Sambhajinagar to bother them.

"Vishakha failed to show that she lives in Chhatrapati Sambhajinagar for school," stated Nikhil Rajendra More and his family.

Court's Analysis

The court looked into whether Vishakha had a real reason to say she was living temporarily in Chhatrapati Sambhajinagar. Even though she said she was there for school, no proof was given that she was signed up for any local school.

Decision by Justice Abhay J. Mantri

Justice Abhay J. Mantri decided on January 9, 2026, that the case couldn't be held in Chhatrapati Sambhajinagar because the location wasn't right. The court stressed the need for real claims about where someone lives when deciding the right place for such cases.

"Temporary living arrangements cannot be made just to create a reason for a court to hear a case," the decision noted.

Summary of the Verdict

The court canceled the earlier decisions that allowed the case to continue in Chhatrapati Sambhajinagar and gave Vishakha the option to file her case in the correct location.
