Quick Summary: In a recent court case, Kinnera Saaraiah wanted to speed up a trial involving a disputed cheque. The court decided not to get involved but urged the trial to move quickly.

Background of the Case

Kinnera Saaraiah, a farmer from Karimnagar district, filed a request under Section 528 of BNSS, 2023. He wanted the Special Judicial Magistrate of First Class (Excise) in Karimnagar to quickly resolve a pending case (Crl.M.P.No.132 of 2025 in C.C.No.284 of 2019).

The Cheque Controversy

Saaraiah's lawyer, Mr. Mirza Azmath Ali Baig, argued that the cheque in question wasn't meant to pay off any debt. Instead, it was supposedly given for a different reason. Saaraiah claimed that Rachamadugu Satyam Rao, the other person involved, had a personal grudge and used fake documents to file the case.

"The cheque was issued for a different reason only," argued Saaraiah's lawyer.

Opposition from the State

The State's representative, Additional Public Prosecutor Sri Jithender Rao Veeramalla, disagreed with these claims. He insisted that the trial court should decide whether the cheque was for a different reason or to pay off a debt, and he asked the court to dismiss Saaraiah's request.

Court's Decision

Judge Tirumala Devi Eada reviewed the case and noted that the accusations against Saaraiah are related to Section 138 of the N.I. Act. The court decided not to get involved in the ongoing court process but emphasized that the trial court should speed up the case. Saaraiah doesn't need to be in court unless specifically required, as long as his lawyer is there.

"The Trial Court is directed to finish the case as quickly as possible," stated Judge Tirumala Devi Eada.

Moving Forward

The court's decision means the trial will continue to find out the truth about why the cheque was given. Meanwhile, other requests related to this case are closed.
