In a recent court decision, Judge Tirumala Devi Eada refused to stop the legal process against Smt Laxmi Bai and Rakesh Goyakar, who are accused of dowry harassment. The case will continue in the trial court.
The case, numbered C.C.No.2596 of 2019, involves accusations under various sections of the Indian Penal Code and Dowry Prohibition Act. The charges include harassment, damaging property, and making threats. Smt Laxmi Bai and Rakesh Goyakar are accused of harassing the complainant, Smt K Divya.
Smt Laxmi Bai and Rakesh Goyakar claim the charges are not true. They argue that the complaint is meant to trouble them. Smt Laxmi Bai is the mother-in-law, and Rakesh Goyakar is the brother-in-law of the complainant's husband. They say they never lived with or bothered the complainant.
"None of the accusations apply to the petitioners who never bothered the complainant at any time."
The prosecution disagreed with the petition. They pointed out that Rakesh Goyakar has been avoiding the police and not helping with the investigation since the police report was filed.
Judge Tirumala Devi Eada looked over the records and decided not to stop the legal process. The court noted that the case is ready for trial and the accusations need to be examined in court.
"The truthfulness of the witnesses can be checked during the trial, so this Court is not willing to interfere with it."
The court ordered the trial to continue without delay. However, the petitioners don't need to attend court unless specifically asked to do so.
The trial will now move forward to determine whether the allegations are true.
