
In a recent decision, the court approved a request to challenge the cancellation of a Gift Settlement Deed. The case was about a land disagreement in Shankarpally, Telangana.
Madupathi Srinivas, the person who brought the case, received a piece of land from his grandmother, Smt. Jangam alias Madapathi Shivaleela, through a Gift Settlement Deed on January 24, 2013. However, this deed was canceled on November 4, 2013, without telling Srinivas, which he argued was against the rules.
"The cancellation was done without giving any notice," argued the lawyer for Madupathi Srinivas and Bollarum Venkat Reddy.
Srinivas sold the land to Bollarum Venkat Reddy, the second person involved in the case, in 2021. When Venkat Reddy tried to sell the land, he found out about the deed's cancellation, which caused problems.
Before the grandmother passed away in 2019, all family members, including those who were entitled to inherit, provided a certificate saying they had no objections. Madapathi Veeramani, Smt. Madapathi Sunandha, and Smt. Madapathi Annapurna, who are family members, confirmed they had no objections to the request.
"We have given no objection affidavit," stated Madapathi Veeramani, Smt. Madapathi Sunandha, and Smt. Madapathi Annapurna in a written statement.
Judge K. Sarath decided in favor of Madupathi Srinivas and Bollarum Venkat Reddy, canceling the cancellation of the Gift Settlement Deed. The court recognized that the cancellation was done improperly and restored the original deed.
"The request is approved by canceling the cancellation," the judgment declared.
This decision ensures the land's ownership remains with Madupathi Srinivas and Bollarum Venkat Reddy, clearing the way for future transactions.
