Bank's Stand

The bank, represented by the Additional Public Prosecutor, opposed the request. They pointed out that the Yadavs hadn't paid the required amounts despite agreeing to a settlement. As of September 16, 2019, they had paid only ₹5,00,000, while they needed to pay ₹28,00,000 as an upfront fee to proceed with the settlement.

"Petitioners have not paid amounts to the bank," stated the prosecutor.

Court's Decision

After looking over the records, the court found that the Yadavs hadn't made further efforts to pay the required amount. Therefore, the court dismissed their request. Judge Tirumala Devi Eada concluded that they were not entitled to any relief.

"The Criminal Petition is liable to be and is accordingly dismissed," ruled Justice Eada.
