Summary: A court case in Mumbai revolves around the alleged forgery of a will by Khushroo Behramshaw Mogal, who claims to be the only person to inherit Hilla Homi Dady's estate. The court finds the will suspicious and orders an investigation.

The Case Begins

Hoshang Jehangir Khan and Rashna Hoshang Khan, who live in Mumbai, started a case to officially approve the will of Hilla Homi Dady. They are the people named to carry out the will dated December 18, 2015. The will is supported by four additional documents, and the deceased's only living heir has agreed to the approval of the will.

The Unexpected Objection

On March 14, 2024, Khushroo Behramshaw Mogal filed an objection, claiming a new will dated March 23, 2023, made him the only person to inherit everything. He backed his claim with a sworn statement, but neither document was initially shared with Hoshang Jehangir Khan and Rashna Hoshang Khan.

Doubts and Suspicions

Hoshang Jehangir Khan and Rashna Hoshang Khan argue that Mogal's will is fake. They point out inconsistencies:

  • Signature Mismatch: The signature on Mogal's will doesn't match previous documents.
  • No Known Relationship: Mogal isn’t a relative or heir according to Indian law.
  • Delayed Action: Mogal waited almost a year to claim his inheritance.
  • No Mention in Previous Wills: Mogal is not mentioned in any earlier will documents.

Allegations Against Mogal

Hoshang Jehangir Khan and Rashna Hoshang Khan claim Mogal has a history of dishonesty. His own family has accused him of blackmail and making fake documents. Legal actions against him include accusations of cheating his wife and faking documents.

"The person objecting has committed several illegal and criminal acts," states Hoshang Jehangir Khan and Rashna Hoshang Khan's lawyer, Mr. Dinyar Madan.

Court's View

Judge Kamal Khata found the will suspicious, noting differences in signatures and the absence of Mogal's name in earlier documents. The court stressed the importance of fairness and ordered an investigation under a specific section of the law.

The Inquiry Ordered

The court instructed a court official to file a complaint with the local magistrate. The complaint will address possible crimes under Indian law, including making fake documents and using them.

Verdict Summary

The court has ordered an investigation to find out the truth about the will and whether Mogal's claims are genuine or not. The investigation will help determine if the will is a forgery and whether Mogal has committed any crimes related to the inheritance.
