Summary: The Madurai Bench of the Madras High Court has canceled a previous decision about who owns a piece of land. The case involves Peri.Muthaiah's request to change the land records in his favor. Judge Senthilkumar Ramamoorthy has instructed the Tamil Nadu Boodan Yagana Board to take another look at the case.
The case began when Peri.Muthaiah asked to change the land records for a piece of land in Kollangudi village. After Peri.Muthaiah passed away, Lakshmi, Meenadevi, Soundaravalli, and Murugan continued the fight. They wanted the court to cancel a previous decision from the local land officer of Kalaiyarkoil Taluk.
Earlier, Peri.Muthaiah and his family had asked the District Collector to take action against two people, Meignanamoorthy and Arockiyam, who were supposedly living on their land without permission. The court didn't take up this request but allowed them to ask the Boomithana Board for land distribution.
"The Division Bench of this Court left it open to Peri.Muthaiah to approach the Boomithana Board for allotment of lands."
The petitioners submitted a request to the Boomithana Board on October 6, 2020. However, their request was turned down, and they were told to ask the Board again. Judge Senthilkumar Ramamoorthy found this unfair and canceled the rejection.
"The impugned order rejecting Peri.Muthaiah's request...does not stand to reason."
The court has now instructed the Tamil Nadu Boodan Yagana Board to reconsider the petitioners' request. They have three months to make a decision after hearing from everyone involved.
The court has ended this case but has given clear instructions for the next steps. Lakshmi, Meenadevi, Soundaravalli, and Murugan are hopeful that the Board will make a fair decision this time.
