Venkateswaran retired on November 30, 2012. Because of some work-related issues, his retirement benefits were put on hold. By February 3, 2020, he owed Rs.5,31,486. The bank said he tried to get his benefits without paying back the loan, which led to a lawsuit in 2020.
Venkateswaran's lawyer, Mr. S. Arun, said the lawsuit was filed too late because the loan was from 2010 and he retired in 2012. He thought the case should be dropped because too much time had passed.
"The case was filed in the year 2020, way past the time limit," argued Mr. Arun.
The bank's lawyer, Mr. L. Dhamodharan, argued that the lawsuit was filed on time. The work-related issues ended on March 5, 2018, and the lawsuit was filed in 2020. He said the case was complicated and needed a trial to look at all the details.
"The time limit issue is a mix of rules and facts," stated Mr. Dhamodharan.
Justice R. Sakthivel decided that the time limit issue needs a trial to look at all the evidence. The court found nothing wrong with the earlier decision to continue with the case.
On February 24, 2026, the court rejected Venkateswaran's request to drop the case. The case will go to trial to decide if Venkateswaran has to pay back the bank.
