"The Tribunal made a mistake in trusting the salary certificate," argued Mr. Dhakshnamoorthy, the insurance company's lawyer.

Court Revises Compensation

The case was looked at again by Mr. Justice C.V. Karthikeyan and Mr. Justice K. Kumaresh Babu on January 22, 2026. They agreed with some of the insurance company's points. The court changed the victim's monthly income and considered shared fault, leading to a lower compensation of Rs.31,88,000.

Breakdown of the New Compensation

  • Loss of Financial Support: Lowered to Rs.26,38,999 after considering shared fault.
  • Spousal Support: Kept at Rs.40,000.
  • Parental Support: Increased to Rs.80,000 for the children.
  • Medical and Funeral Costs: Kept at Rs.3,98,403 and Rs.15,000, respectively.
