On February 24, 2019, a terrible accident happened in Namakkal. The victim, who worked as a Dyeing Master, was riding his scooter when another vehicle hit him. He got seriously hurt and sadly passed away on March 4, 2019. His family asked for financial help, and the Motor Accident Claims Tribunal initially decided they should get Rs.37,44,403 on October 26, 2021.
Shriram General Insurance Co. Ltd., located in Namakkal, didn't agree with the Tribunal's decision. They appealed, saying the amount was too much. They questioned the salary proof and claimed the victim was partly responsible for not wearing a helmet.
"The Tribunal made a mistake in trusting the salary certificate," argued Mr. Dhakshnamoorthy, the insurance company's lawyer.
The case was looked at again by Mr. Justice C.V. Karthikeyan and Mr. Justice K. Kumaresh Babu on January 22, 2026. They agreed with some of the insurance company's points. The court changed the victim's monthly income and considered shared fault, leading to a lower compensation of Rs.31,88,000.
The court ordered Shriram General Insurance Co. Ltd. to pay the new amount within 30 days, keeping the interest rate at 7.5% per year from the original request date.
