On November 25, 2025, Justice Sunder Mohan made a decision on a case involving Dhas, who was accused of illegal activities related to M-Sand transportation. The case was filed under C.C.No.248 of 2025 at the Judicial Magistrate-I in Padmanabhapuram, Kanyakumari District.
The accusations were pretty serious. Dhas, the owner of a quarry, was accused of encouraging the transportation of extra M-Sand without a proper permit. This was done by the driver and owner of a tipper lorry, who were also involved in the case.
Dhas argued that he had a valid Certificate of Registration under the Tamil Nadu Prevention of Illegal Mining Act. He claimed that the charges should only be a minor rule-breaking under this act, not theft.
"The police had filed a final report for the crime of theft, which is not applicable," said Dhas's lawyer.
Justice Sunder Mohan referred to another case, Devanandh vs. State of Tamil Nadu, to point out that theft charges require taking minerals without permission. Since the M-Sand was from Dhas's own property, the court found that no theft had occurred.
The court dismissed the theft charges but noted that if there were any rule-breaking related to the license, separate actions could be started under the Mines and Minerals Act.
The court's decision means the final report in C.C.No.248 of 2025 is dismissed, and the related other requests are closed. However, authorities can still take action if any license rule-breaking is found.
