Magesh sold diesel to Vel and Co on credit. By March 31, 2018, they owed him over 38 lakh rupees. Even with this debt, he kept supplying diesel, and the amount grew to over 1.5 crore rupees. They gave him a cheque on September 10, 2018, but it bounced the next day because the account was closed.

"The cheque was returned as 'account closed'," said Magesh.

Court Actions: Trying to Seize Properties

Magesh wanted the court to take properties owned by Vel and Co’s partners and their family members, thinking they were trying to avoid paying by moving their assets.

Legal Back-and-Forth

  • First Court Order: The Ranipet court told the defendants to provide some form of guarantee by November 27, 2019. They didn’t do it.
  • Temporary Measures: Magesh got a temporary order to seize properties, but the court later refused his request for more seizures, saying the ones in place were enough.

The Twist: Bank Gets Involved

Tamil Nad Mercantile Bank asked to remove the property seizure, claiming they had an interest in the properties. On August 4, 2025, the court agreed, making Magesh’s case more complicated.

Justice R. Sakthivel decided on December 9, 2025:

  • Seizure Allowed: For properties listed as 'B', 'C', and 'E'.
  • Seizure Not Allowed: For property 'D', because there wasn't enough proof it was connected to Vel and Co’s business.

The court allowed Magesh to seize some properties to cover the unpaid diesel debt, but not all properties he wanted. This means Magesh might finally get some of the money he's owed, although it hasn't been an easy process.
