Balakrishna Rao was declared bankrupt in 2001, which made any deals he made more complicated. There were also claims that his signature on the MOU was forged.

The court agreed with the Deputy Registrar's decision from August 20, 2009, which turned down Dasaprakash Restaurant's request to be listed as a co-owner of the brand name. The judgment stressed that one owner cannot give away rights without the agreement of all other owners.
"The first respondent considered all these important facts and correctly rejected the application filed by the appellant in Form TM-24."
