The court decided not to drop the charges against Kottur Shanthan Kumar, who was accused of dowry harassment and making threats. The case will go to trial instead.

Background of the Case

Kottur Shanthan Kumar, a businessman from Secunderabad, is facing charges related to dowry harassment and making threats. These charges are under laws that deal with such issues.

What the Petitioner Said

Kumar's lawyer, Mr. Shashank Garige, argued that the accusations were not true. He mentioned that Kumar's marriage in 2020 had problems, and his wife never had a good relationship with her in-laws. Because of these issues, a divorce case was filed and granted, although an appeal is still ongoing. Kumar also pays his wife a monthly support of Rs. 6,000, as ordered by the court.

"The present complaint is filed by the person with all false allegations," said Mr. Garige.

The State's Argument

The State, represented by Mr. Jithender Rao Veeramalla, responded by highlighting statements from community elders. These statements include specific allegations against Kumar, suggesting there is more to the story.

Court's Decision

Justice Tirumala Devi Eada looked over the records and decided that the trial should go ahead. She noted that the truth of the allegations would be figured out during the trial. The court also allowed Kumar to skip personal appearances in court if he is represented by a lawyer, except when his presence is specifically required.

"The truth of the statements of the witnesses and the truth or otherwise of the allegations against the petitioner can be tested during the trial," said Justice Eada.

What’s Next?

The trial court is directed to handle the case quickly. Meanwhile, Kumar must ensure his lawyer is present at every hearing.

In summary, the court decided that the case should go to trial to determine the truth of the allegations.
