In a surprising turn, Judge J. Sreenivas Rao has dismissed a request by K. Narayanappa, who wanted to cancel a criminal case against him. The case involves accusations of cheating related to buying a villa in Hyderabad.

The Villa Deal Gone Bad

K. Narayanappa, the person who made the request, made a deal with Ambience Properties Limited to buy Villa No. 40. The total cost was Rs. 1,10,00,000, with an extra Rs. 65,00,000 for building work. However, problems arose when Narayanappa allegedly didn't pay.

The Bouncing Cheques Story

Narayanappa gave several post-dated cheques to Ambience Properties. Unfortunately, these cheques didn't go through, leading to a complaint and a legal fight. Despite trying to settle the issue, including offering a mortgage as security, the argument got worse.

"Ambience Properties found out that the property used for the mortgage was already promised to the State Bank of Hyderabad."

The Court's Opinion

Judge Rao decided there was enough proof to continue with the case. The court mentioned that just because there are other ongoing cases doesn't mean this criminal case can't happen.

"The judge...decided that there is a clear case to answer."

Legal Arguments

Narayanappa's lawyer said the case was a civil matter, not a criminal one, and should be canceled. However, Ambience Properties' lawyer argued that Narayanappa intended to deceive from the beginning.

Previous Cases and Decisions

Both sides mentioned different past legal cases. The court ultimately agreed with Ambience Properties, saying there was a clear case of alleged cheating.

Summary of the Verdict

The court rejected Narayanappa's request, allowing the criminal case to continue. This decision shows that civil disagreements can lead to criminal charges if there is any dishonest intention.

"Narayanappa doesn't have to be present in court unless specifically needed."
