In a surprising turn of events, the court dismissed the case involving Sanjay Kumar Jain simply because he couldn't be found. Here's what happened.
Sanjay Kumar Jain, who lives in Hyderabad, was involved in a case against the Assistant Commissioner of Income Tax, also based in Hyderabad. The case was being heard by Judge P. Sam Koshy and Judge Suddala Chalapathi Rao.
Mr. K. Maneesh Mahinvith, representing Mr. CKR Associates for Sanjay Kumar Jain, said that despite their best efforts, they couldn't get in touch with Jain. He seemed to have disappeared, leaving his legal team without any instructions.
"The person who appealed has not been contacting us nor can we find him," said Mr. Mahinvith.
With no contact from Jain, the judges had no choice but to dismiss the case. Judge P. Sam Koshy noted that the dismissal was because they couldn't continue the case without Jain being involved.
The court did leave the door open for Jain. If he ever reappears and still has complaints, he can file a new application with valid reasons to restart the case.
"The appeal is accordingly dismissed, as having become pointless," declared Judge Koshy.
The court closed the case with no decision on who should pay for the legal costs and also wrapped up any other requests related to it. So, for now, this case is closed unless Jain decides to come back.
