Hyderabad City Civil Court: Orders Expedited Trial in Family Partition Case

Background of the Case

Dr. Mahesh Kumar Kedia filed two cases for dividing family property back in 2016. These cases involve several family members, including Vijender Kedia, Gulzarilal Kedia, Premalatha, Shakuntala Agarwal, Santosh Agarwal, Usha Agarwal, Umesh Kedia, Anita Goel, and Jitender Kedia, and have been stuck in the trial phase for years.

Stuck in Limbo

The cases, numbered O.S.No.840 & 709 of 2016, are being handled by the 14th Additional Chief Judge at the City Civil Court in Hyderabad. The cases have seen little progress, mainly due to delays in recording Dr. Mahesh Kumar Kedia's evidence.

"The trial has been postponed for more than 7 to 8 years with no progress," said Dr. Mahesh Kumar Kedia's lawyer, Mr. K. Mahit Reddy.

Temporary Order and Its Impact

A temporary order to keep things the same might be causing the delays. This order seems to have made it less urgent for Dr. Mahesh Kumar Kedia to present evidence.

Court's Directive

Judge P. Sam Koshy looked at the situation and decided that the trial court needs to act more decisively. He instructed that the trial should start promptly and be completed within a year from the next hearing date.

"Justice will be served if the trial court takes these matters more seriously," stated Judge Koshy.

Conclusion of the Petitions

The civil revision petitions have been resolved, with no extra costs imposed. All pending miscellaneous petitions are also closed.
