
Here's the scoop on a recent case involving Amit Kailas Varghade, a 24-year-old businessman from Pune, who’s been trying to get bail. The High Court of Bombay just gave a nod to his appeal, which was delayed by 118 days.
Amit Varghade was denied bail by the Additional Sessions Judge in Pune on December 6, 2024. He’s facing serious charges under the Indian Penal Code (IPC) including murder and other offenses, along with charges under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Amit wanted to challenge the bail refusal, but he was late by 118 days. The law usually doesn’t allow appeals after 180 days unless there’s a really good reason. Amit’s side argued that there was a good reason for the delay.
Amit’s Side: His lawyers pointed to other cases where delays were forgiven, arguing that the delay was due to being involved in the trial and a change in judges which slowed things down.
State of Maharashtra and Others' Side: The other side argued that Amit didn’t have a good enough reason for the delay.
Judge S. M. Modak decided that Amit did have a good reason for the delay. The judge noted, “In criminal law, the ‘right of a speedy trial’ is recognized as a ‘basic right’.” So, even though Amit took part in the trial, he still had the right to ask for bail.
“I consider it as a good reason for allowing the delay.”
The court has allowed the appeal to move forward, and the case will be back in court on October 16, 2025, to discuss how the rest of the trial will be handled.
