Summary: The High Court has stopped the Rs. 3,000 charge for each event at K.G.N. Function Hall, questioning if the charges are legal.
K.G.N. Function Hall, represented by its owner M.A. Raoof, took legal action against the State of Telangana and Ramagundam Municipal Corporation. The function hall challenged a notice from November 5, 2015, which demanded a fee of Rs. 3,000 for each event held there.
The main argument presented by K.G.N. Function Hall was that the Ramagundam Municipal Corporation did not get the necessary government approval for these charges. This step is required under a law from 1955. The court noted, "Looking at the notice, it does not show that any such approval was obtained."
Judge C.V. Nagarjuna Reddy was in charge of the case. After reviewing the petition and hearing arguments from both sides, the court decided to stop the enforcement of the fee notice. This means the Rs. 3,000 charge per event cannot be collected until further notice.
"There shall be a hold on the enforcement of the notice," stated the court.
The court has scheduled the next hearing for February 22, 2016. Until then, K.G.N. Function Hall does not have to pay the user charges. The Ramagundam Municipal Corporation is expected to provide a response explaining their side.
This case highlights the importance of following rules and getting proper approval before charging fees.
