In a recent court decision, Ram Shovit Singh, the tenant, lost his case against Sangeeta Gupta because he failed to submit necessary paperwork on time. The court decided he must leave the property.

The Delay Problem

Ram Shovit Singh, through his lawyer Mr. R. K. Sharma, wanted to cancel an eviction order because he didn’t submit his defense on time. The court allowed a delay of 33 days in submitting and 5 days in re-submitting his request, but it wasn’t enough to change the outcome.

What Happened?

The case started when Ram Shovit Singh didn’t respond to an eviction notice within 15 days, as required by the rules. The eviction was granted because he didn't file a "leave to defend" application. Ram Shovit Singh argued he wasn't properly informed, blaming the Process Server’s reports as false and manipulated.

“The tenant only visited occasionally, leaving the premises locked,” claimed the Process Server.

The Court’s View

Judge Saurabh Banerjee noted that several attempts were made to deliver the notice to Ram Shovit Singh, but he wasn’t found at the address. The court decided that posting the notice on the door was valid. Ram Shovit Singh, who worked nearby, didn’t take timely legal action even after knowing about the eviction order.

Past Cases

The court referred to previous cases, emphasizing that tenants must respond within 15 days to challenge an eviction. Without a timely response, the landlord's claims are accepted by default.

Final Decision

The court dismissed Ram Shovit Singh's request and upheld the eviction. Judge Banerjee ruled that Ram Shovit Singh must leave the property since the six-month legal period had passed.

“The petitioner is required to vacate and hand over the peaceful and physical possession,” concluded the judgment.

This case highlights the importance of responding quickly to legal notices and following deadlines in eviction matters.
