
The Delhi High Court, led by Judge Girish Kathpalia, agreed with a decision to stop further questioning opportunities for M/S EC Constructions in a case against Neeraj Zutshi and another person. This decision was made because of repeated delays and unpaid fees by M/S EC Constructions.
This case has been ongoing since 2006. M/S EC Constructions faced problems when the court decided to stop their chance to further question a key witness, DW1, due to unpaid fees from previous delays.
On August 1, 2025, the court refused a request from M/S EC Constructions' lawyer, who said they needed more time. The court noted that previous delays were requested on false reasons, like illness or family issues, without proper proof.
"Such false statements coming from a lawyer before the trial court as well as this court are not acceptable."
The lawyers for the other side, Mr. Sahil Gupta and Mr. Arjun Aggarwal, argued that M/S EC Constructions was intentionally delaying the case. They showed evidence of repeated delays requested by M/S EC Constructions, suggesting a pattern of stalling.
The court found that M/S EC Constructions had plenty of time to prepare, as DW1's written statement was shared in 2020. Despite this, many delays were requested over the years, with fees imposed but not paid.
"The trial court was completely justified in stopping further questioning of DW1."
Judge Kathpalia dismissed the request, agreeing with the trial court's decisions and adding an extra fee of Rs.10,000 on M/S EC Constructions. This amount is to be paid to the other side within two weeks.
