
In a recent court decision, BSES Yamuna Power Limited was told to provide electricity to buildings even if they have unauthorized construction. Let's break down what this means and why it happened.
The main players are BSES Yamuna Power Limited, the electricity provider, and several respondents, including Bhagwanti & others, who own or occupy the buildings in question. The case was heard by Justice Mini Pushkarna on November 13, 2025.
The problem started when the Consumer Grievance Redressal Forum (CGRF) told BSES Yamuna Power Limited to give electricity connections to buildings that were flagged for unauthorized construction. Normally, BSES says no electricity should go to these places.
"The CGRF has directed the petitioner to grant electricity connections to premises booked for unauthorized construction."
The Municipal Corporation of Delhi (MCD) has marked these buildings for unauthorized construction, but they haven't taken action yet. Why? There are a few reasons:
Justice Mini Pushkarna decided that since these buildings are occupied and need electricity, BSES should provide it. This is to prevent illegal electricity use and ensure safety.
"Grant of electricity connection in the meanwhile, pending action against unauthorized construction."
The court said BSES could cut off electricity if MCD finally takes action. Until then, electricity should keep flowing to avoid theft and danger.
"The electricity company shall be free to disconnect the electricity connection, as and when such request or direction is given by the MCD."
The court decided that BSES Yamuna Power Limited must provide electricity to buildings with unauthorized construction because they are occupied and need electricity for safety. However, if the Municipal Corporation of Delhi takes action against these buildings, BSES can then cut off the electricity.
