Summary: On December 6, 2025, the High Court of Delhi decided against Radhey Shyam Chouhan, telling him to leave a property in Chandni Chowk. Judge Saurabh Banerjee agreed with the eviction order because the landlord needed the space.
The case is about a property in Chandni Chowk, Delhi, called "Rath Khana." This property includes a large room with a tin roof, located at Municipal No.447, Cycle Market, Esplanade Road. The landlords, Radha Sharma and others, said it was their family property.
Who owned the property was made clear through a court case in 1982 and a later decision in 1986. The landlords needed the space to start a vegetable business, saying they had no other good place to do it.
Radhey Shyam Chouhan, the tenant, said the landlords were not the real owners. He claimed the property belonged to a temple and that the landlords were just caretakers.
The Rent Controller at Tis Hazari Courts, Delhi, rejected Chouhan's defense in March 2018. Chouhan's appeal to the High Court was based on different reasons, including a 1987 receipt from the Municipal Corporation of Delhi, suggesting the property was temple-owned.
Judge Saurabh Banerjee said that Chouhan's arguments were not valid. The court pointed out that Chouhan's father, who was involved in the original case, never argued about who owned the property. The court said that the earlier decisions were final for Chouhan.
"The decision made by the higher court is final and applies to his son, the tenant here."
The High Court rejected Chouhan's request on December 6, 2025, agreeing with the eviction order from 2018. The court told Chouhan to leave the property right away.
