The State, represented by Mr. Utkarsh Singh and Inspector Vikas, wanted this bail taken back, saying it was too soon in the investigation to let her go.
Justice Girish Kathpalia was in charge of the case. The State argued that Asha Kaur's bail should be taken back because she avoided answering questions during questioning. They also mentioned a statement by her son-in-law, but it didn't provide any evidence against her.
"If the person asking questions isn't skilled, you can't blame the person answering for avoiding questions," said Justice Kathpalia.
Justice Kathpalia found no proof that would justify taking back Asha Kaur's bail. The court noted that there was no evidence found against her, and the son's confession didn't lead to any discoveries that involved Asha.
On February 5, 2026, the High Court decided not to take back Asha Kaur's bail. The decision emphasized that the conditions of her bail ensure she will attend the trial and not mess with evidence.
"I am unable to find any issue with the previous decision," concluded Justice Kathpalia.
This decision means Asha Kaur can stay free on bail, as the court found no strong reason to take it away.
