A Pattern of Legal Action

Hanspal has a history of filing requests about illegal building work. His first request was on April 7, 2025, about a different property. Each time, he either withdrew or did not follow through with the requests, often after the alleged illegal buildings were dealt with by the property owners themselves.

Court's Observations on Hanspal's Motives

The court, led by Justice Mini Pushkarna, noted that Hanspal's requests seemed to lack genuine intent. The repeated filing and withdrawal of requests suggested hidden reasons. The court emphasized that legal processes should not be abused for personal gains.

"It is well settled by a long line of judicial pronouncements that a petitioner... must come with clean hands," the court remarked.

Financial Penalty Imposed

Given Hanspal's behavior, the court dismissed the request and imposed a fine of ₹50,000. This amount is to be paid to the D.H.C. B.A. Costs Account within four weeks, to prevent future misuse of the legal system.

MCD's Responsibility

Despite dismissing the request, the court instructed the MCD to continue dealing with illegal buildings according to the law. This ensures that while the petitioner’s actions were punished, the main issue of illegal building work is not ignored.

Next Steps

The case is set to be reviewed on January 9, 2026, to ensure compliance with the court's order regarding the payment of the fine.
