Bay Resorts had been part of many legal fights about the property in question. They even got a temporary court order in 2003 to stop others from interfering with their property. Despite this, Nenmeli Arulmigu Alavandar Naicker Charity had an earlier temporary court order in their favor from 2002.
Justice P.B. Balaji was in charge of the case. He pointed out that Bay Resorts' reasons for the delay were not good enough. The court stressed that the company couldn't depend only on one director for legal stuff, especially when another director, Mr. Sakthivel, had been actively involved in other legal matters.
"The excuse given by the company is clearly not acceptable," the court stated.
On December 12, 2025, the court rejected the request to change the earlier decision, leaving Bay Resorts without any help. This decision highlighted how important it is to act quickly and have proper representation in legal matters.
