The Case Begins

Aman Jaiswal, a law student at Maharashtra National Law University in Nagpur, faced a difficult situation. In November 2023, he couldn't take his 5th Semester exams because he didn't attend enough classes. The university told him to leave the hostel on July 19, 2024, and he wasn't allowed to take exams again in November 2024.

Legal Action and Dismissal

Aman decided to challenge this decision. He filed a legal case (No. 4878/2024) to fight it. Unfortunately, the case was dismissed because his attendance was below the required 67%. The court said the university couldn't change this rule.

Student Grievance Redressal Committee Steps In

Aman, along with another student, went to the Student Grievance Redressal Committee (SGRC) under the University Grants Commission Rules of 2023. On April 12, 2025, the committee suggested that Aman should be allowed to take his exams without any penalty.

“The committee recommended that a special exam should be conducted for him during the scheduled re-examination in June-July 2025.”

University’s Stand and Legal Interpretation

Even though the SGRC suggested allowing Aman to take exams, the university didn't agree. They said the suggestions needed to be approved by a higher authority. However, Judges Anil L. Pansare and Raj D. Wakode explained that the SGRC's suggestions were mandatory and didn't need more approval.

Consequences of Non-Compliance

The court pointed out that not following the SGRC's suggestions could lead to big problems for the university, like losing funding or other penalties under the University Grants Commission Act, 1956.

Final Verdict

On November 28, 2025, the court decided in favor of Aman. The university was told to follow the SGRC's suggestions and let him take the exams. The judges stressed that the suggestions were obligatory and should be followed without needing extra approvals.
