Quick Summary: Shiva Prasad Malothu, who works for the government, was worried about being arrested for an online scam he says he didn't do. The court has now told the police they must follow the rules before they can arrest him.

Background on the Case

Shiva Prasad Malothu, who works in a district cooperative office in Karimnagar, got into trouble when the police said they might arrest him. This was because of a complaint about online money fraud from someone named Rajaram in Chennai. Shiva says he doesn't know Rajaram or anything about the cybercrime in Chennai.

What Shiva Prasad Malothu Wanted

In his request to the court, Shiva Prasad Malothu asked the court to stop the police from arresting him when no crime has been officially recorded against him. He said the police's actions were wrong and not fair.

"To declare the high handed action of the respondents... in threatening to arrest the petitioner... is illegal, arbitrary, contrary to law..."

Court's Decision

Judge N.V. Shravan Kumar, who was handling the case, talked about a similar case (W.P.No.30019 of 2025) where the court had already told the police to follow the rules before doing anything. Shiva Prasad Malothu's lawyer asked for the same decision for his case.

Police's Response

The Assistant Government Pleader for Home, who was speaking for the police, didn't argue against the request. This means they agreed with the court's earlier decision to follow the rules.

Final Order

The court told the police to follow the proper steps before doing anything else to Shiva Prasad Malothu. It also said that Shiva should help out with any investigation.

"This writ petition is disposed of directing the respondents to follow due procedure... It is also made clear that the petitioner shall cooperate with the enquiry."

With this order, Shiva Prasad Malothu can feel a bit more at ease knowing that the police need to follow the rules before they can arrest him.
