Payments and Promises

DSL paid Rs. 4 crore upfront and another Rs. 1 crore in September 2020. According to the deal, the remaining Rs. 4 crore was due 12 months after Niche Builders handed over the property. But Niche Builders didn't deliver the property, causing the dispute.

"Niche Builders failed to deliver the empty physical possession of the Demised Property to Dharampal Satyapal Limited."

Third-Party Concerns

DSL found out that Niche Builders might be selling the property to someone else. This broke the agreement, which didn't allow any deals with others until the sale was finished.

Legal Moves

DSL filed two requests: one asking for arbitration and another asking the court to stop any sale of the property. On September 17, 2025, the court ordered that nothing should change with the property, which is still in place.

Arbitration Request

On September 22, 2025, DSL asked for arbitration, saying there were unresolved arguments. However, Niche Builders said the request was too late and that the deal couldn't be enforced.

Court's Decision

On January 28, 2026, Justice Harish Vaidyanathan Shankar decided that the case should go to arbitration. Retired Justice Shalinder Kaur was chosen as the arbitrator. The court also said that nothing should change with the property until the arbitrator makes a decision.

The arbitrator will now look into the details, including whether the deal is valid and if DSL's claims are legitimate. Both parties will share the arbitration costs equally.
