
On December 9, 2025, the Delhi High Court made an important decision in a case involving Sh. Davesh Singh and Sh. Hawaldar Singh and others. The court decided whether Davesh Singh could get another chance to question a key witness again.
The issue started when Sh. Davesh Singh wanted to look again at a previous order from April 15, 2025. This order had denied his request to bring back a witness, known as PW1, for questioning. The original chance for this questioning was on July 22, 2024, but it was moved to August 5, 2024, because the needed official documents were not available.
On August 5, 2024, the official witness showed up, but without the necessary documents. This caused another delay, moving the next trial date to October 22, 2024. Unfortunately, on that day, the main lawyer for Davesh Singh did not show up, leading the trial court to reject the request to call the witness again. This rejection was later confirmed, leading to the current request.
Justice Girish Kathpalia, who was in charge of the case, found no error in the previous orders. However, to ensure a fair trial, he gave Davesh Singh one last chance to question PW1. This chance comes with a condition: Singh must pay Rs. 50,000 to the other party, Sh. Hawaldar Singh, within two weeks.
"The petitioner/defendant no.2 may be granted one and only one opportunity to conclude cross-examination of PW1, subject to heavy cost."
Both sides are scheduled to appear before the trial court on December 16, 2025. On this date, a new date will be set for the questioning. Davesh Singh must make sure that the official witness is present with the necessary documents. This will be his final chance, regardless of whether the documents are provided.
