Everest Entertainment tried to stop a movie from being released because they said it copied their work, but the Bombay High Court didn't agree with them. The court didn't find enough proof that the movie copied Everest's work.

Case Background: Everest vs. Manjrekar

Everest Entertainment LLP took Mahesh Vaman Manjrekar and others to court, saying their movie "Punha Shivaji Raje Bhosale" copied Everest's movie "Mee Shivajiraje Bhosale Boltoy." They said the other movie copied their script, ads, and title.

Court Proceedings: Delay and Objections

The case was looked at by Justice Amit S. Jamsandekar. Everest wanted to stop the movie from coming out on October 31, 2025. But the court pointed out that Everest waited too long to file the case, even though they knew about the copying since April 2025.

"There is no explanation whatsoever in the pleadings of the Plaintiff about the delay since April 2025," the judge stated.

The Arguments: Copyright and Reputation

Everest said they had special rights to the movie's title, script, and ads. They thought the movies were so similar that people would get confused. But the other side said their movie was original and had different themes and stories.

Judgment: No Copying Found

Justice Jamsandekar decided there wasn't enough copying of Everest's work. He said the other movie was completely new and didn't agree with Everest's claims.

"The dialogues, the storyline, the thought process behind the plots and the plots, sequence of events, characters, etc., are totally different from that of the Plaintiff."

Final Decision: Request Denied

The court didn't give Everest what they wanted because there wasn't enough proof and they waited too long to take action. The case will have a final hearing in November 2025.

The court's decision shows how important it is to act quickly and have strong proof in cases about copying someone else's work.
