Delhi HC: Bail Granted in Paharganj Transgender Assault Case

On February 27, 2026, the Delhi High Court made an important decision in a case involving an assault and robbery in Paharganj. Judge Girish Kathpalia allowed the accused, Rukhsar and Khushboo, to be released from jail temporarily under certain conditions.

The Incident in Paharganj

The case is about an event where three transgender individuals allegedly attacked another transgender person with sticks, causing an injury above the victim's right eye. The victim also said her handbag, which had Rs. 5,00,000 in cash and gold jewelry, was stolen.

"Three transgenders assaulted the victim with sticks, causing an injury above the right eye."

Lawyers and Arguments

Rukhsar and Khushboo, represented by lawyer Ms. Vartika Maurya, asked for bail before getting arrested. They argued that they hadn't done anything wrong while free and mentioned that one of the three accused had already been granted bail.

The State, represented by Mr. Sanjay Sabharwal and officer Sandeep, argued against the bail, worrying it might encourage the accused. They pointed out that the third attacker got bail only after being arrested, not before.

Medical Report and Investigation

The victim's medical report showed minor injuries, including swelling over the right eye and a scratch on the back. Although Rukhsar and Khushboo participated in the investigation, there were complaints about how well they cooperated.

"The injuries were opined to be simple by the doctor."

Court's Decision

Judge Girish Kathpalia found no reason to deny Rukhsar and Khushboo their freedom. The court allowed them to be released from jail temporarily, requiring each to pay a personal bond of Rs. 10,000 with someone to vouch for them. Additionally, they must check in at the police station every Wednesday at 10:00 am for two months to make sure they follow the rules.

"Both these applications are allowed... they shall report before the IO every Wednesday."

This decision shows the court's effort to balance the rights of Rukhsar and Khushboo with the need for the investigation to continue.
