The lawyers for the state, led by Mr. Amit Ahalwat along with SI Mohit and HC Tinku, admitted there was no direct proof against Adil. They acknowledged that the statement from Monis, which blamed Adil, was made while Monis was in custody and did not lead to any new findings.
"There is currently no evidence against the accused/applicant," said the state lawyer.
The prosecution was against giving bail because of Adil's past involvement in similar cases. The Investigating Officer (IO) mentioned that Adil was involved in four other similar cases, all within the same area, and was already out on bail for those cases.
Judge Girish Kathpalia decided that there was no need to take away Adil's freedom since he didn't need to be questioned while in custody. The court allowed the advance bail, as long as Adil provided a personal bond of Rs. 10,000 with one person guaranteeing the same amount.
"I do not find any reason to take away the accused/applicant's freedom," said Judge Kathpalia.
Adil was instructed to participate in the investigation whenever asked in writing by the IO. The related application was also closed by the court.
