In a recent court decision, Hans Raj, the tenant, was ordered to leave the place he was renting in Ranjit Nagar, New Delhi, after missing important deadlines in his eviction case. Here's a breakdown of what happened.
Kishori Lal, the landlord, asked the court to evict Hans Raj under the Delhi Rent Control Act. He wanted Hans Raj out of the property in Ranjit Nagar because he planned to start a business there. The property is ideally located near a school, making it perfect for selling books and school supplies.
The court sent a notice to Hans Raj on September 3, 2024, but it wasn't delivered because the place was locked. A new notice was sent on November 4, 2024, with a court date set for January 9, 2025. Meanwhile, a notice was also published in a newspaper on December 25, 2024.
Hans Raj showed up in court on January 9, 2025. Although he was given extra time to prepare his defense, he turned it in late on February 12, 2025. The rules required him to respond within 15 days of getting the notice.
Justice Saurabh Banerjee looked over the case. The court found that Hans Raj didn't act quickly enough, even though he knew the eviction process was urgent. The judge stressed the importance of following the strict timelines in eviction cases.
"The specified period of fifteen days is mandatory and inflexible," noted Justice Banerjee.
On December 22, 2025, the court rejected Hans Raj's request to cancel the eviction order. He must leave the property and hand it over to Kishori Lal after six months, as per the law.
This case shows how important it is to follow legal deadlines in eviction cases. Missing these deadlines can lead to losing your home, as Hans Raj experienced.
