In a recent court case, Judge K. Lakshman made a decision about a disagreement over a land sale involving Khaja Moinuddin and the State of Telangana. The case was about a piece of land in Gadimunkanpally Village and a disputed sale agreement.
Khaja Moinuddin said that his late father, Lal Ahmed, owned a piece of land and agreed to sell it to Khaja Miya for ₹37 lakhs. However, Khaja Miya supposedly never paid the agreed amount. Despite this, a sale document was signed on September 14, 2022.
"Khaja Miya did not pay the said amount."
Moinuddin's father tried to cancel the sale appointment and submitted objections to the authorities, but they were ignored. The District Collector was asked to look into it, but nothing was done.
Meanwhile, another person, Mohammed Moulana, filed a lawsuit claiming he had an earlier agreement to buy the land. The court issued a temporary order to prevent any changes to the property, and this case is still going on.
Judge K. Lakshman pointed out that the sale document was registered with a stated price of ₹10,000, which goes against Moinuddin's claim of ₹37 lakhs. The court stressed that revenue authorities cannot solve disputes over payment differences.
"Khaja Moinuddin cannot file the present Writ Petition seeking cancellation of the said sale deed on the ground of non-receipt of sale consideration."
The court dismissed the request, advising Khaja Moinuddin to find other legal ways to get back the money through a different lawsuit.
"Liberty is granted to Khaja Moinuddin to avail remedies available under law."
This case shows how complicated land deals can be and the importance of having clear and well-documented agreements.
