Summary: The Bombay High Court decided to give more money to the family of a truck driver who died in an accident. The court agreed that Samsuddin Islamoddin Ansari’s monthly earnings should be higher than what was first decided, which changed the amount of money the family would receive.
In a sad accident on March 10, 2019, Samsuddin Islamoddin Ansari, a truck driver, died when he slipped off the truck and was run over by it. His family, including his wife Rubinaanjum and their children, asked for money under a law that helps workers' families when they die, seeking payment for his early death.
At first, the person in charge decided that the family should get ₹12,23,100 with an interest rate of 12% per year. A fine of ₹2,00,000 was also given to the truck owner because they took too long to pay the money.
The National Insurance Co. Ltd. disagreed with the amount of money and the fine. Meanwhile, Rubinaanjum and her family argued back, saying the money was not enough and should be based on a higher monthly pay for Samsuddin.
The court had to decide if Samsuddin's pay should be limited to ₹8,000 per month according to a 2010 rule or be thought of as more. The court decided that his actual pay should be ₹15,000 per month, considering the type of work he did and the expected increase in pay.
The court changed the payment to ₹15,28,875, showing the higher monthly pay. It also kept the fine against the truck owner, saying that the person in charge had the right to decide the fine amount.
The court decided to increase the compensation for the family based on a higher monthly income for Samsuddin. The penalty against the truck owner remained the same, ensuring that the family received a fair amount reflecting their true financial loss.
