The Legal Battle Begins

Ajeet Seeds filed a request in the Bombay High Court. They argued that Regulation 6 was beyond what the NMC was allowed to do and violated Articles 14 and 19 of the Indian Constitution. They wanted the court to cancel this rule and let them continue with their plans.

"Regulation 6 of the 2023 Regulations is unconstitutional and beyond legal authority," argued Mr. V.D. Sapkal, the senior lawyer for Ajeet Seeds.

The Court's Decision

The case was heard by Judges Sandipkumar C. More and Abasaheb D. Shinde. On January 28, 2026, the court ruled in favor of the NMC. They decided that Regulation 6 was valid and aimed at ensuring medical education was not profit-driven.

Why the Court Agreed with the NMC

The court found that the rule was consistent with the NMC Act's goal to maintain high standards in medical education. They believed allowing only Section 8 Companies would prevent commercial exploitation in medical education.

"The regulation ensures that medical education remains aligned with broader public interest," the court noted.
