Quick Summary: In a recent case from Aurangabad, Vijaykumar and Anilkumar Kucheriya were found guilty of breaking a court order by selling land. The judge, Shailesh P. Brahme, decided they didn't do it on purpose and let them off with a warning.

The Family Feud Over Land

The case involves Vijaykumar and Anilkumar Kucheriya, both 72, from Parbhani, and their relative, Sushilkumar Kucheriya. The dispute is over a piece of land known as Gut No.84. The trouble started when Vijaykumar and Anilkumar claimed this land was theirs after a family split.

The Court Orders and the Sale

On April 3, 2025, a court order was issued to stop any sales of the land until things were sorted out. However, Vijaykumar and Anilkumar went ahead and sold parts of the land on July 18 and 19, 2022. Sushilkumar, who was not happy with this, took them to court for breaking the order.

"The people who appealed were bold enough to say that no argument was happening in court."

Judge's Decision

Judge Shailesh P. Brahme looked into the case and found that Vijaykumar and Anilkumar did indeed break the court order. However, he believed they didn't do it on purpose. They had apologized and claimed they didn’t know about the order. The judge decided not to punish them harshly because there was no bad intent.

The Arguments

The judge considered arguments from both sides. Vijaykumar and Anilkumar's lawyer, Mr. Milind Patil, argued that they didn't know about the order. On the other hand, Sushilkumar's lawyer, Mr. P. V. Sonpethkar, insisted they knew about it and should be punished more.

Conclusion of the Case

In the end, Judge Brahme decided not to send them to jail. He believed they didn't mean to break the rules and accepted their apology. The court allowed their appeal, and Sushilkumar's request for a harsher penalty was turned down.

"Considering everything that happened, I find that they have shown it was not on purpose."

This case highlights how family arguments can get out of hand and the importance of following court rules. While the court found a rule was broken, the lack of intent to disobey led to a lenient outcome.
