Background of the Case

On February 20, 2023, a fight broke out near a shop in Badarpur, Delhi. Avtar, who is physically challenged, and his friend Rahul were involved in a quarrel with an unknown person. This escalated behind a temple, where Rahul was seen attacking the unknown person with a stick. The next day, a dead body was found in a pit behind the temple, leading to the arrest of both Avtar and Rahul.

Avtar's Defense

Avtar's lawyers, Mr. S. C. Malhotra and Mr. Kunal Kishore, argued that he was wrongly accused. They highlighted his disability, as Avtar is in a wheelchair with amputated legs, making it unlikely for him to commit such an assault. They stated:

"It is not possible to believe that the accused/applicant could have assaulted the deceased."

Prosecution's Argument

The prosecution, represented by Mr. Amit Ahlawat and Inspectors Ishwar Singh and Sushil Sanwaria, opposed the bail. They claimed there was evidence against Avtar, including a stick with blood stains. However, no fingerprints were found on it.

Court's Decision

Justice Girish Kathpalia was in charge of the case. He noted the lack of solid evidence and Avtar's physical limitations:

"I find it difficult to believe his involvement in killing the deceased."

Given these observations, the court decided to grant bail to Avtar on January 21, 2026. He was released on a personal bond of Rs.10,000 with one surety.
