
Syeda Parveen Sultana asked the court to let her husband, Syed Afsar, out of jail temporarily because she was sick and there were important festivals coming up. However, the court dropped the case because her husband had already been let out.
Syeda Parveen Sultana wanted her husband, Syed Afsar, to be let out of jail temporarily. She mentioned her serious illness and the upcoming Holi, Ramzan, and Shawaal Eid festivals as reasons. Her husband was in Cherlapally Central Jail, serving time for several cases.
“...release the petitioner's husband on parole despite severe illness of the petitioner as well as the ensuing Holi, Ramzan, and Shawaal Eid Festival...”
Interestingly, no one showed up in court to speak for Syeda Parveen Sultana. The case was heard by Justice N. Tukaramji, with Mr. R. Laxmikanth Reddy speaking for the government.
Mr. R. Laxmikanth Reddy, the Assistant Government Lawyer, told the court that Syed Afsar had been let out on October 13, 2018. This made the request unnecessary.
Justice N. Tukaramji decided that since Syed Afsar was already out of jail, the request was pointless. Therefore, the case was dropped as unnecessary, with no extra costs charged.
“...the cause raised in this petition does not survive for adjudication and accordingly, this petition is dismissed as infructuous.”
The case shows how legal actions can sometimes become unnecessary when things change.
