"The person who made the complaint has raised false accusations...there is a delay of 25 days in reporting the complaint."
Sri Jithender Rao Veeramalla, the Additional Public Prosecutor, argued that just because there was a delay, it wasn't enough to cancel the case. He mentioned that the alleged crimes have a punishment of less than seven years and noted that there were 14 complaints pending against Sai Prasad.
Sai Prasad's lawyer admitted to the 14 cases but said that all were closed except for one still open in Ranga Reddy Court. This was confirmed by records showing the ongoing investigation under Sections 292, 351(2), 189 read with 190 of the BNS, 2023.
Judge Tirumala Devi Eada instructed the police to follow Section 35 (3) of the BNSS and the guidelines from the Supreme Court in Arnesh Kumar v. State of Bihar. Sai Prasad was told to help with the investigation by giving the necessary documents and information.
"The person asking for the cancellation shall provide his side of the story and help the Investigating Officer...the Investigating Officer shall finish the investigation according to the law."
The court decided not to cancel the legal case and emphasized the importance of a complete and fair investigation. All other related requests were closed.
