In a recent court case, Judge N. Tukaramji ruled in favor of two women, Smt Devineni Vidyarani and Smt K Sravanthi, who said they were being wrongly threatened with being kicked out of their homes in Secunderabad.
Smt Devineni Vidyarani and Smt K Sravanthi, represented by their agent Sri H Srikanth, asked the court for help under a part of the Indian Constitution. They wanted protection from being forcefully removed from their land by the police, who were allegedly acting on behalf of another person, Smt T Savithri.
"The police unlawfully entered the petitioners’ property and threatened them with forcible dispossession unless they vacated the premises."
The people on the other side, including the State of Telangana and local police officials, said these accusations were not true. According to Mr. R. Laxmikanth Reddy, the Assistant Government Lawyer, there was no interference with Smt Devineni Vidyarani and Smt K Sravanthi’s property. They argued that the claims were baseless and lacked evidence.
After looking at the case, Judge N. Tukaramji decided that the police should not get involved in what was really a disagreement between private parties. He told the respondents not to bother Smt Devineni Vidyarani and Smt K Sravanthi's hold on the property, unless it was done through legal means.
"The respondents are restrained from disturbing the petitioners’ possession over the property, save and except in strict accordance with law."
The court's decision ensures that Smt Devineni Vidyarani and Smt K Sravanthi can stay in their homes without fear of being unlawfully evicted. The ruling emphasizes the importance of following legal steps in property disagreements and limits what the police can do in such civil matters. The case was closed with no extra costs ordered, and any other pending requests were also closed.
