
The court decided not to allow the sale of firecrackers at the Kukatpally Housing Board (KPHB) Colony temple bus stop. The decision was made because no one had applied for permission to sell there.
The case was heard by Justice B. Vijaysen Reddy. The petition was filed without any real reason. Mr. Layeeq Khan, the lawyer for the person who filed the petition, faced arguments from Mr. K. Ravi Mahender, the lawyer for GHMC, and the Assistant Government Lawyer for Home. They pointed out that the bus stop wasn't meant for firecracker sales.
"The writ petition is filed without any cause of action."
It was also noted that nobody had asked for permission to sell firecrackers at the bus stop. This lack of application was a key point in the court's decision.
Justice Reddy made it clear that if anyone wants to sell firecrackers at the bus stop in the future, they must apply first. The GHMC and the Home department should then notify the person who filed the petition and give them a chance to speak.
"If any permission is sought... issue prior notice to the petitioner."
The case was closed without any extra costs. This means the person who filed the petition didn't have to pay additional fees. Any other requests related to this case were also closed.
This decision ensures that no firecracker sales happen without proper permission and notice.
