
In a recent decision, Judge Nagesh Bheemapaka dealt with a contempt case involving the Telangana State Financial Corporation. The case was about claims that a court order related to getting back money wasn't followed.
The case, Contempt Case No.1573 of 2024, was filed because people said that the court's earlier order from November 9, 2024, wasn't obeyed. This order was part of a legal request (WP.No.40172 of 2014) that told them to take action to recover money from certain borrowers.
The person who brought the case is T Sudheer Kumar, a bank officer from Hanamkonda Town, Warangal District. The person being accused is Sri D Venkataswamy, a manager at the Telangana State Financial Corporation, located in Warangal.
The court had earlier told Sri D Venkataswamy to start actions to recover a one-time settlement amount from the borrowers mentioned in the legal request.
"This Court by the aforesaid order had directed the respondent No.1 therein to proceed with recovery proceedings..."
Sri D Venkataswamy provided a statement saying that the recovery actions had indeed started. On November 1, 2024, the borrower's unit was taken as part of these actions. There were plans to sell the unit to the public, with notices to be published in newspapers.
"They have initiated recovery proceedings against the borrower for recovery of dues and finally seized the unit of the borrower..."
Judge Nagesh Bheemapaka recognized Sri D Venkataswamy's actions and their promise to finish the recovery process within two months. With these promises, the contempt case was closed, and no extra costs were added.
"Since, the respondent... has given undertaking to this Court that they will complete the recovery proceedings within a period of (02) months, by placing the same on record, the Contempt Case is closed."
