Summary: A court threw out a challenge to a Lok Adalat decision from 2001 because the challengers waited 24 years without a good reason. They claimed fraud but didn't back it up with evidence.

The Case Background

In this situation, Sunkekar Dhrupathi Bai and Madhabhai Patekar filed a request to overturn a decision made by the Lok Adalat in 2001. The decision was part of a case managed by the Junior Civil Judge at Bhainsa. The challengers argued that the decision was obtained through dishonest means by the respondent, Babu Patekar, who works as a Deputy Forest Range Officer.

The Long Delay

The big issue for the court was the huge 24-year delay in challenging the decision. Justice Moushumi Bhattacharya noted that the challengers didn't explain why they waited so long. They only mentioned fraud in a vague way, without solid proof or details.

"The request filed by the challengers does not contain a single line explaining the delay of 24 years," noted Justice Bhattacharya.

Ongoing Legal Battles

Interestingly, Sunkekar Dhrupathi Bai and Madhabhai Patekar have another case (W.P.No.9353 of 2024) waiting to be decided against the same person. Their lawyer mentioned this, but it didn't help their case here. The court thought that since they were already trying to get help in another case, this challenge was unnecessary.

Court's Decision

With no good reason for the delay and another case already ongoing, the court decided to throw out the challenge. Justice Gadi Praveen Kumar agreed with the decision, saying the challenge had no strong points and was filed too late.

"The current request has no strong points and should be dismissed," concluded the court.

Verdict Summary

The court dismissed the challenge due to the 24-year delay and lack of evidence for the fraud claims. The ongoing case against the same respondent didn't justify reopening this old decision.
