
In an interesting turn of events, Ashapura Options Private Limited, led by Director Mr. Pravin Chamaria, has taken legal action against Ashapura Developers and others. The case is about who gets to use certain office spaces in Mumbai, and the court's decision has favored Ashapura Options, at least for now.
Ashapura Options says they were given office spaces on the 9th floor of the Hallmark Business Plaza in Mumbai back in 2011. They claim this was part of a business deal with the Ashapura Group, where they spent a lot of money, Rs. 8 crores, to set up the offices.
But things changed in April 2025 when security guards and bouncers supposedly blocked their access, and their things were reportedly taken out of the offices. This led Ashapura Options to file a case under a law that helps people get back property they believe is rightfully theirs.
Judge Sandeep V. Marne was in charge of the case. He pointed out that Ashapura Options had been using the office spaces since 2011 and had documents to show they were still using them. The court said that even if the electricity was turned off in 2024, it didn't mean Ashapura Options gave up their right to be there.
"The possession needs to be effective, undisturbed, and to the knowledge of the owner," the court stated, explaining what it means to truly have possession of a place.
The defendants, represented by Mr. Simil Purohit, argued that Ashapura Options were just using the office spaces with permission and didn't have any real claim to them. They mentioned a 2014 agreement where Ashapura Options supposedly agreed they didn't own the spaces. However, the court found that this agreement was mainly to protect Ashapura Developers in a different dispute with Aditya Birla Retail.
The court decided in favor of Ashapura Options, allowing them to keep using the office spaces. Judge Marne ruled that the defendants couldn't just take matters into their own hands and force Ashapura Options out without going through proper legal channels.
"Plaintiffs have made out a clear case for a temporary order," Judge Marne concluded, ensuring Ashapura Options could stay in the offices while the case continues.
The temporary arrangement lets Ashapura Options stay in the offices as the case goes on. The court has planned more hearings to look at other issues, making sure everything is carefully reviewed.
